Terms & Liability Waiver

1. Age Certification

Renter certifies they are 18 years of age or older, or are a legal guardian signing on behalf of a minor aged 10–17 who meets all other requirements.

2. Weight Requirements

Renter certifies they weigh between 90 and 265 lbs (41–120 kg), which is the mandatory safety rating for this equipment as specified by the manufacturer. Use outside this range creates a life-threatening risk of equipment failure.

3. Physical Fitness

Renter certifies they are in adequate physical condition to navigate strenuous, vertical terrain and are free of any medical conditions — including but not limited to heart conditions, seizure disorders, vertigo, or impaired balance — that would prevent safe participation in via ferrata climbing.

4. Equipment Rental Only

Denali Ventures LLC is solely an equipment rental company and does NOT provide guide services, instruction, safety assessments, or any evaluation of fitness or climbing ability. The renter is solely responsible for determining whether they are capable of safely using this equipment and navigating the route.

5. Inherent Risk Acknowledgement

Via ferrata climbing involves INHERENT RISKS including falls, rockfall, lightning, equipment failure, human error, and death. Renter voluntarily accepts all such risks.

6. Equipment Inspection & Return

Renter agrees to inspect all rented equipment upon pickup and will not use any gear they believe to be damaged or defective. All gear must be returned to the designated Smart Locker in the same condition as received by the agreed-upon return date. Renter accepts a $150/day overdue fee and full replacement cost for lost or damaged gear.

7. Release of Liability

Renter RELEASES, WAIVES, AND DISCHARGES Denali Ventures LLC, its officers, members, employees, and agents from any and all liability, claims, and causes of action — including negligence — arising from use of rented equipment or participation in via ferrata climbing at Ashley Gorge, Vernal, Utah.

8. Truthful Certification

Renter understands that by completing the digital certification, they are making legally binding statements. Providing false information constitutes fraud and any injury resulting from a false certification is the renter's sole legal responsibility.
